Should the 1913 cut off-date for land claims be changed to the 1800s?

In support of black empowerment, South Africa reopened its land claim process in June 2014 after closing it at the end of 1998, giving land claimants another five years to lodge claims. Any person or community dispossessed of land rights after 19 June 1913 as a result of racially discriminatory practices are able to lodge a claim to restore such a right or receive compensation by 30 June 2019.

1913Any person or community dispossessed of land rights after 19 June 1913 as a result of racially discriminatory practices are able to lodge a claim to restore such a right or receive compensation by 30 June 2019.

President Jacob Zuma raised the prospect of shifting the goal posts today in terms of land claims, re-opening the debate on whether the cut-off date for claims should be 1913 when legislation paving the way for black people to be dispossessed of their land was passed.

Zuma noted, “I believe in percentage wise, the land taken after 1913 is very small, very insignificant than the land that was taken…particularly in 18-something – that’s when the biggest chunk of land was taken.”

Zuma said currently the land claims process was skewed against South Africas black populace. It is very easy for a land owner to say you don’t own the land.

“I believe, as a son of a black man, being black, being on my own as always, that you need to shift that cut-off date, but you need to find a reasonable way of addressing the issue, within the Consitution, within the law…,”

He quoted former ANC secretary general Sol Plaatje, who wrote that when the Land Act came into force, black men went to sleep owning land, and woke up being worse off than slaves. Souh Africa reopened its land claims process in 2014.

Barclays loses faith in Africa?

However I believe that the real reason for this response was due to Jacob Zuma, President of South Africa who recently changed his finance minister three times in less than a week. Such a move at a time when the country’s economy is under-performing has hit the confidence levels of investors in the country.

Barclays Africa Group Limited, which includes the South African branch network Absa, is listed on the Johannesburg stock exchange and is 62 % owned by the UK bank. It is one of the largest banks on the continent, with a SAR991bn balance sheet, more than 40,000 staff and 1,267 branches across 12 countries.

Who could blame them for leaving?…

I assumed Barclays had big plans as they were in discussions of rebranding the Absa branch network in South Africa under its own colours after increasing its stake in the Johannesburg-listed business. Barclays business in Africa accounts for 20% of the British banks earnings and has actually been growing.

So why does it want to sell its 62% stake in South Africa’s ABSA bank and essentially pull out of Africa within the next three years?

Jes Staley, Barclays new CEO, notes that to rethink the business and forced him to ways to cut costs and raise capital for its flagging investment business.

Staley, as part of the banks annual results announcement, said going forward the bank will focus on two divisions: Barclays UK and Barclays Corporate and International.

However I believe that the real reason for this response was due to Jacob Zuma, President of South Africa who recently changed his finance minister three times in less than a week. Such a move at a time when the country’s economy is under-performing has hit the confidence levels of investors in the country.

Another reason is the devaluation of the South African rand against the British pound which has reduced the recent contribution of the African business to the overall banking group’s profits. For 2014, Barclay’s earned a return on equity of 9.3% from its African operations which was lower than its target of 11%.

What you will NOT hear at the “State of the Nation” Speech

We are thinking that foreigners will save our economy – not true! They will exploit our lands and take our bounty… When would our Bantu people learn that they are short changing the sons and daughters of this land… Wise up! For this is the “State of the Nation”, and Zuma with all his gang from all parties today will give you a good show and trade you shiny objects in exchange of your land and soul – just like the Dutch had done when Jan Van Riebeck and his Investors came.

In recent months there has been much talk about the economy, corruption and salary increases. However, I feel that we are only gazing at magicians at work. This has become a cheap Las Vegas show to which the “sleight of hand” of the illusionists, who gets the DA to protest about jobs and gets the EFF to protest about Zuma’s fall.

Whilst the policy makers who have a seat in Parliament are out campaigning they are also busy cutting deals behind close doors which are only good for themselves. Yet the people only see as the audience – mere spectators. The fact of why our currency has weakened, or why we are inviting more foreign investors to pursue on the quest to colonise us once more.

Our country is being sold right under our feet, piece by piece. South Africa – be careful and don’t be too eager to blame Zuma – for one man cannot run a country by himself. Where is the DA, EFF, or the others when these foreigners come to sign up for a “one stop shop deal”?  There are other parties in Parliament you know, representatives are allowed to speak up – so why are they not shouting at things which pertain to the long term strategies? … It’s because South Africans love to be entertained whilst foreigners are aligning to slave trade you!

Is Civil War Brewing in South Africa?

Inevitably, frictions between the ANC & EFF are ever increasing with opposing views, and each one attempting to take control of the spoils. Could this be the brewing of civil war in South Africa?

The Economic Freedom Fighters (EFF) led by Commander and Chief Julius Malema has in recent years dominated the political stage of South Africa. Despite eefthe leadership change of the Democratic Party, the main opposition party to the government, they have still been overshadowed by the EFF.

In contrast, and no matter how corrupt the African National Congress (ANC) has become they are still being seen as the undisputed “heavy weight champion” political party of South Africa.

The EFF are not shy to controversy, proudly wearing berets and red overalls, not mentioning the many disruptions to Parliamentary proceedings and opposing to a non-compliance of any rule or protocol even with their own leader recently suspended for openly accusing an h0nourable peer as a murderer. The EFF continues to grow and samobilize attracting its followers with a better life of taking it by force from those who have “plenty”.

Meanwhile the ANC are observing and are clearly struggling to deal with the Prodigal son, Malema. It’s been so long that anyone so radical as JuJu (Malema)- who has shaken up the years of complacency and security that no party would be able to challenge their right to the throne. So confident that even President Jacob Zuma even once mentioned that “the ANC will be in power even when Jesus comes”.

Inevitably, frictions between the ANC & EFF are ever increasing with opposing views, and each one attempting to take control of the spoils. Could this be the brewing of civil war in South Africa?

Would you agree that our President Zuma is an “angel” compared to Julius Malema?

These are crucial times for South Africa despite President Zuma’s corruption cases. Mr Zuma has done his best in developing trade and industries in South Africa whereas Julius Malema may be too inclined with black supremacy to seek the overall economic benefit of South Africa!

Boundaries move slowly but gradually just enough so that society does not realise the ground that they were standing on has moved. The political landscape of South Africa is changing and it’s changing using humour. Many of South Africans don’t mind bad news so long as it comes with humour, as being very much optimistic we South Africans would not admit to the glass being half-empty.
jz
It is with that as a premise to which I would like to mention the person who is keeping our President Zuma up at night that he actually had to build a state of the art bunker at his popular homestead.

We must recognise and be alert that Julius Malema is no Mandela or Zuma! In fact he is an inexperienced, uneducated politician with radical ideology to that synonymous of Robert Mugabe.

jmI strongly believe that the mainstream media will regret providing Malema all the free publicity to fuel his campaigns. May the same media not forget that he was the one verbally abused the British reporter years back, once in power he will remove all freedom of expression. Thus labelling anything opposing to his thinking as “racist”.

These are crucial times for South Africa despite President Zuma’s corruption cases. Mr Zuma has done his best in developing trade and industries in South Africa whereas Julius Malema may be too inclined with black supremacy to seek the overall economic benefit of South Africa!

South Africa is for Sale?

Left, right and center – corrupt government officials are raping South Africa whilst we place our hand on heart – singing, Nkosi sikelel’ iAfrika. If the price is right they too could arrange a meeting for you – We need to stop these Pimps in government before it’s too late!!

The South African government which is meant to be safeguarding our country, should have the country’s interest at heart. Yet we read of the daily accounts of government officials abusing the system and of their many indictment corruption charges. Our very government officials have no patriotism or love for our country.

zumThey are no different to the Colonist who ravaged and plundered our country. They speak from the ivory towers mentioning how they fought for liberty and freedom yet many government officials have the philosophy, “eat, drink and be merry for tomorrow we die”. Total disregard for the next generation and the talks of Ubantu and the Rights and Civil liberties of the African people are all but hogwash.

From the President to the street-sweeper, everyone has a price that they will be willing to sell their integrity and that the sale of South Africa is merely a prostitute commodity to their pension scheme. Our hopeless, uneducated President is now in talks with Russia, China, Cuba and India (not mentioning every other country which has abused its people) – Zuma has opened South Africa’s doors, he has stripped her beauty, tore her lovely dress and exposed her for sale.

Take for example, just yesterday Elisha Matsipa, was arrested for assisting a Pakistani national Wahdat Hussain, to fraudulently obtain a South African passport, identity document and a marriage certificate. Matsipa received an amount of R23, 000 from Hussain.rape

Today’s news will have another account of another story of some other unpatriotic official allowing someone to have a go at raping our country. This has become normal because it happens everyday – but this is NOT normal, its wrong!

Left, right and center – corrupt government officials are raping South Africa whilst we place our hand on heart – singing, Nkosi sikelel’ iAfrika. If the price is right they too could arrange a meeting for you – We need to stop these Pimps in government before it’s too late!!

A Solution to South Africa’s Chaos!

In the United Kingdom we go about our business freely with no apparent fear of crime even at night. There is an efficiency of the judicial system and the predictability and probability, as opposed to a remote possibility; of paying for one’s crime is the reason behind the peace and overall stability the people enjoy.

South Africa desperately needs a truly independent and efficient judiciary. When citizens know that there is an effective and efficient court system in their country and that arrest, prosecution, conviction and sentence for the guilty is predictable, then corruption and crime in general will go down.

Those who may wish to take power through unconstitutional means would be deterred from forging ahead with their unconstitutional plans by what an independent judiciary in their country could do to them.

When the other branches of government know that courts as the guardians of the constitution will always do their job without fear, favour or prejudice, they will observe and promote the rule of law.

When it is known that a challenge to the executive’s failure to deliver on a constitutional obligation could result in an executable court order against anybody from the president to a mayor, of their own accord government functionaries and role players in business will obey the law of the land, observe business ethics and good governance will materialise.

Seducing Voters results in Political Whores leading!

Many vote for the ANC not because of Jacob Zuma or others but because they appreciate the party which sacrificed so much to bring them to freedom. The nation’s father, Madiba is also the reason many vote ANC but when the people begin to realise that its own government is robbing them.

This would be considered to be betrayal. South Africa is on a time bomb and the people of South Africa are a passionate, patriotic people who I believe will soon revolt against the abuses Zuma’s government and restore the ANC to the ideologies of the true revolutionaries gone-by! Amandla Awethu!

Leadership requires good basic communication skills and an acceptable level of education. I’m informed that most communities (predominately literate) are easily swayed by the candidate whose “bribe-gift” is worth the most. These gifts consist of Maize meal, beans (food items, etc.).

Given the short-sightedness of these voters and the mockery of the sacrifices of the lives sparred so that every South African can choose a candidate for the betterment of the country not their stomachs.

Despite the distastefulness of this method in seducing voters, the authorities seem to have turned a blind-eye to this open bribery. Most councillors, who are voted in, are confronted on day one of the job displaying a lack of communication skills and have a low level of education and etiquette.

One of the common reasons for selecting a candidate is their rhetoric, many councillors still appear to give liberation speeches as if it South Africa was still oppressed by apartheid.Hate speech is a common mean in rallying the masses, promising them homes, jobs, and the possessions of the non-African.

We are losing the confidence of the international community and potential/current investors. Zuma, as the President of South Africa, should realise that at the heart of the observance to the rule of law, which the Constitutional Court of South Africa explained in these terms:

‘The exercise of public power must … comply with the constitution, which is the supreme law, and the doctrine of legality, which is part of that law. The doctrine of legality, which is an incident of the rule of law, is one of the constitutional controls through which the exercise of public power is regulated by the constitution. It entails that both the Legislature and the Executive “are constrained by the principle that they may exercise no power and perform no function beyond that conferred on them by the law”. In this sense the Constitution entrenches the principle of legality and provides the foundation for the control of public power.’

Central to the affirmation or oath of office is the obligation to uphold the foundational values of our constitutional democracy, which include the rule of law, human dignity, equality, freedom, transparency and accountability.

141204zuma-jpg

The Rule of Law is the concept that a functioning society needs an accessible, independent and transparent legal system, along with a set of laws that everyone, including the government, follows. Where the Rule of Law is strong, day-to-day essentials such as health, safety, shelter, employment, education and family are often taken for granted.

Where the Rule of Law is weak, the above-mentioned essentials are often absent and suffocating poverty, debilitating illness, human rights violations and government corruption stand in their place. Does Zuma want to destroy South Africa or maybe he just is not qualified for the job?
